The latest position with regards to Blue Square North club Hyde United`s winding up order has been explained by chairman Steve Hartley.

Hartley said: “I consulted with solicitors on Thursday morning, and established that there is an opportunity to go back to the High Court with a request that the winding-up order be rescinded.

“This has to be done within seven days, but practically will need to happen by Monday at the latest. The club will have to have in place funds to pay the petition debt of around £122,000 in full, plus related legal costs, which may be significant, and be able to convince the court that it is sufficiently solvent to continue to trade.

“We will have a much improved chance if we can also convince the Official Receiver. There are no guarantees, because at the end of the day it is the decision of the judge, who has to safeguard all the club's creditors not just HM Revenue & Customs.

“The club needs to raise around £35,000 over the next couple of days, but this is not impossible. Obviously any help, no matter how small would be greatly appreciated. The funds will be placed in a solicitors clients' account and will be returned in the event of the order not being rescinded.

“As things stand at the moment the club has been wound up, and therefore is unable to fulfil its fixture in the FA Cup on Saturday. I have, however, contacted the FA, and requested a postponement of the fixture for one week, to allow us the opportunity to rescind the winding-up order. In reality we will be charged by the FA for not fulfilling the cup fixture, and will have to appeal to the cup committee. This is the best we could hope for.

“I have also consulted with the Football Conference, and established that if the order is rescinded, it would be as if it had never happened, we would not be in an insolvency event, and we would not suffer a points deduction. This would of course be subject to ratification by the Conference board.

“Finally, I have passed a message via manager Neil Tolson to the players, requesting them not to do anything until our future is known for certain.

“Thanks to all those who have contacted the club either directly or through the forum. It is good to know that we are well respected, and I thank them for their best wishes.

“The board will do everything in their power to enable the club to survive.”
